Zaustaviti diskriminaciju i ispraviti nepravdu u pravosuđu prema Bošnjacima

Bošnjačko nacionalno vijeće je danas uputilo zahtjev Predsjedniku Srbije, predsjedniku Vlade, predsjednici Skupštine, ministru pravde, Odboru skupštine za pravosuđe, državnu upravu i lokalnu samoupravu i Državnom vijeću tužilaca Srbije za obezbjeđivanje zastupljenosti Bošnjaka u postupku izbora javnih tužilaca na područjima za koje su mjesno nadlježna Viša javna tužilaštva u Novom Pazaru i Užicu.

U dopisu je jasno izražen protest zbog nastavka diskriminacije Bošnjaka u oblasti pravosuđa i zahtjev za usaglašavanje nacionalne strukture nosilaca javnotužilačke funkcije u Sandžaku sa nacionalnom strukturom stanovništva u sandžačkim opštinama.

Ukoliko se ova i ovakva diskriminacija i nepravde ne isprave, te ukoliko se nastavi sa grubim kršenjem Ustava i zakona Republike Srbije i ignorisanjem preporuka nadležnih međunarodnih institucija, BNV upozorava da će se ozbiljno dovesti u pitanje legitimitet i legalitet pravosudnih organa u Sandžaku u odnosu na Bošnjake.

Znajući da suverenost potiče od građana i da su građani Republike Srbije bošnjačke nacionalnosti, između ostalih, nosioci njene suverenosti, svako nepoštovanje, ignorisanje i uskraćivanje ostvarivanja prava pripadnika bošnjačke nacionalne zajednice predstavlja rušenje i obesmišljavanje pravnog poretka Republike Srbije.

Bošnjačko nacionalno vijeće zahtijeva poštovanje odredaba III mišljenja Savjetodavnog komiteta Parlamentarne skupštine Savjeta Evrope kao i postupanje po Izvještaju Evropske komisije o napretku Srbije u 2015. godini, u okviru izvještaja o poglavlju 23 „pravosuđe i osnovna prava“, u kome je konstatovano da Bošnjaci u Sandžaku i dalje  nisu dovoljno zastupljeni u sudstvu i policiji.

Prijedlogom za izmjene i dopune akcionog plana za ostvarivanje prava manjina, Bošnjačko nacionalno vijeće, zahtijevalo je od državnih organa da hitno obezbijede usaglašavanje nacionalne strukture u policiji, sudstvu i tužilaštvu, ali i uspostavljanje Apelacionog suda i tužilaštva  za područje Sandžaka, uspostavljanje privrednih sudova za Sandžak, otvaranje odjeljenja upravnog suda kao i osnivanje pravosudne akademije za Sandžak.

Bošnjačko nacionalno vijeće ne prihvata ovakvo stanje i traži od Evropske unije i drugih međunarodnih institucija da učine dodatne napore i pomognu Vladi Srbije i drugim državnim institucijama da isprave ovu nepravdu i obezbijede adekvatnu zastupljenost Bošnjaka u sudstvu i tužilaštvu.

Stop discrimination and correct the injustice against Bosniaks in the judiciary

The Bosniak National Council sent a request today to the President of the Republic, President of Government, President of National Assembly, Minister for justice, Committee for judiciary, State Administration and Local Self-government, and to the State Council of Prosecutors in Serbia, for ensuring representation of Bosniaks in the selection of public prosecutors in areas which are territorially in jurisdiction by Senior Public Prosecutor's Offices in Novi Pazar and Uzice.

The letter was clearly expressing protest over the continuing discrimination against Bosniaks in the area of ​​justice and demand for harmonization of national structures in regard to judicial and public prosecution functions in Sandzak with the ethnic structure of the population in Sandzak municipalities.

If these and such discrimination and injustices don’t get corrected, and if it’s continued with a gross violation of the Constitution and laws of the Republic of Serbia and ignoring the recommendations of international institutions, the Bosniak National Council warns that this might seriously call into question the legitimacy and legality of the judicial authorities in Sandzak against the Bosniaks .

Knowing that sovereignty derives from the citizens and that Bosniak citizens of the Republic of Serbia, among others, are the holders of its sovereignty, therefore any disrespect, ignorance and denial of the rights of the Bosniak national community represents destruction and making legal system of the Republic of Serbia senseless.

The Bosniak National Council requires compliance with the 3 provisions of opinions of the Advisory Committee of the Parliamentary Assembly of the Council of Europe as well as actions by the European Commission's progress report on Serbia in 2015, in the report on Chapter 23 – “Judiciary and Fundamental Rights”, in which it was stated that the Bosniaks in Sandzak are still not sufficiently represented in the judiciary and the police.

Proposal for amendments to the Action Plan for the realization of the rights of minorities, the Bosniak National Council, required by the state authorities to urgently ensure harmonization of the national structure in the police, judiciary and prosecution as well as the establishment of the Court of Appeal and the prosecution of Sandzak region, the establishment of commercial courts in Sandzak , open departments of the administrative court and the establishment of the Judicial Academy for Sandzak.

The Bosniak National Council does not accept this situation and has asked the European Union and other international institutions to make further efforts to assist the Government of Serbia and other state institutions to correct this injustice and ensure adequate representation of the Bosniaks in the judiciary and prosecution.
